1. ACCEPTANCE OF TERMS
By purchasing Litter Glitter or using this website, you agree to these Terms of Service.
If you do not agree, do not purchase or use our products.

2. WHAT LITTER GLITTER IS (AND ISN'T)
Litter Glitter is a household cat litter additive.

It is NOT:
A veterinary product
Medicine or a medical treatment
Intended to diagnose, treat, cure, or prevent any disease

Your Responsibilities:
✓ Use the product as directed on the packaging
✓ Monitor your cat for any sensitivity or unusual reactions
✓ Stop using immediately if irritation or unusual behavior occurs
✓ Consult a veterinarian if your cat has pre-existing medical conditions before use

We assume that you:
Have read and understood the product instructions
Will use the product only as directed
Will seek veterinary care if your cat shows adverse reactions

3. ASSUMPTION OF RISK
By purchasing Litter Glitter, you acknowledge that:
Any product used in a pet's environment carries some level of risk
You assume full responsibility for using this product with your animals
You will monitor your pet's reaction to the product
Individual cats may react differently to ingredients
If you're unsure whether Litter Glitter is safe for your specific cat, consult a veterinarian before use.

4. WHAT WE'RE LIABLE FOR (AND WHAT WE'RE NOT)

Our liability is limited to the maximum extent permitted by law:
Our total liability for any claim related to Litter Glitter cannot exceed the amount you paid for the product. For example: If you bought one bag for $24, our maximum liability is $24.

We are NOT liable for:
Indirect, incidental, or consequential damages
Veterinary bills or medical expenses
Emotional distress
Lost income
Property damage beyond the product itself
Any damages resulting from misuse of the product

Exception: We don't limit liability for fraud or gross negligence

If we intentionally harm you or act with gross negligence, normal liability rules apply. This limitation only applies to ordinary product claims.

5. NO WARRANTIES (EXCEPT WHERE REQUIRED BY LAW)
The product is sold "as is" and "as available."

We do not guarantee:
That the product will work for every cat
That your cat will prefer it
Specific results or outcomes
That your cat's behavior will change

However: Some states don't allow "as is" sales. If your state requires warranties, you have whatever warranties your state law requires.

Our 90-Day Guarantee (see Return Policy) is our voluntary customer satisfaction policy, not a legal warranty.

6. ORDERS, PRICING & AVAILABILITY

We Reserve the Right To:
Refuse or cancel any order for any reason
Correct pricing errors (even after you've ordered)
Limit quantities per customer
Discontinue products at any time

If We Cancel Your Order:
We'll notify you by email
We'll refund any payment you've made
We're not liable for any other costs or damages

Pricing Errors:
If we discover a pricing error after you've ordered:
We'll give you the option to cancel or pay the correct price
If you choose to cancel, we'll issue a full refund

7. SUBSCRIPTIONS
Subscription purchases are governed by our Subscription Policy.

Key Points:
Minimum 2 deliveries required
Early cancellation fee: $6.00 (difference between subscription and retail price)
You're charged when each shipment is prepared
Cancel anytime after 2nd delivery

8. RETURNS & REFUNDS
Returns and refunds are governed by our 90-Day Return Policy.

90 days from order date to request refund
Email required with photos (product + cat)
May need to return product by mail
One refund per household

9. INDEMNIFICATION (WHEN YOU'RE RESPONSIBLE)

You agree to protect us from legal claims if:
You misuse the product
You violate these Terms
You violate the law
You violate someone else's rights

Example: If you use Litter Glitter in a way we explicitly told you not to, and someone sues us because of it, you agree to cover our legal costs.

This does NOT apply if we're at fault or you used the product as directed.

10. FORCE MAJEURE (THINGS BEYOND OUR CONTROL)

We're not liable for delays or failures caused by:
Natural disasters (hurricanes, earthquakes, floods)
Pandemics or public health emergencies
Government actions or regulations
Supply chain disruptions
Shipping carrier delays
Labor disputes or strikes
Utility outages
War, terrorism, or civil unrest

What Happens:
Performance is suspended during these events
We'll resume as soon as reasonably possible
You won't be charged for delayed subscription shipments
We're not liable for damages caused by these delays

11. DISPUTE RESOLUTION – ARBITRATION

Agreement to Arbitrate:
Any dispute between you and Litter Glitter must be resolved through binding individual arbitration, not court.

This includes disputes about:
The product
These Terms
Your purchase
Advertising or marketing claims
Privacy or data practices

Exceptions (you CAN go to court for these):
Small claims court (if claim is under your state's small claims limit)
Intellectual property disputes
Injunctive relief (court orders to stop something)

How Arbitration Works:

12. CLASS ACTION WAIVER
All claims must be brought individually.

You agree NOT to:
Participate in class action lawsuits
Join consolidated proceedings
Participate in representative actions
Serve as a class representative

The arbitrator cannot:
Consolidate multiple people's claims
Preside over any class or representative proceeding
Award relief to anyone except you individually

Exception: If a court finds this class action waiver unenforceable, the entire arbitration agreement (Section 11) is void, and disputes go to court instead.

13. GOVERNING LAW
These Terms are governed by the laws of [Your State].

We don't apply conflict of law principles (rules about which state's law applies when there's a dispute).

Exception: Federal arbitration law (Federal Arbitration Act) governs the arbitration provisions.

14. CHANGES TO THESE TERMS

Changes take effect immediately upon posting

Your Continued Use = Acceptance:

15. SEVERABILITY
If any part of these Terms is found to be unenforceable, the rest still applies.

Example: If a court says the arbitration clause is invalid, everything else in these Terms remains in effect.

16. NO WAIVER
If we don't enforce a right under these Terms, that doesn't mean we've given up that right.

Example: If we let you return a product outside the 90-day window once, that doesn't mean we have to do it again.

17. ENTIRE AGREEMENT
These Terms, plus our Return Policy, Subscription Policy, and Privacy Policy, make up the entire agreement between you and Litter Glitter.

They replace any prior agreements, discussions, or understandings.
